1 Acceptance of Terms
By accessing, browsing, registering an account, or interacting with Mobile Plaza via web or mobile application, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must immediately discontinue use of the platform.
2 Marketplace Platform Role & Transaction Disclaimer
Classifieds Venue Model:
• Mobile Plaza is an online classifieds directory and technology platform. We connect prospective mobile phone buyers directly with independent physical retail shops located in commercial plazas (e.g., Mandian, Abbottabad and affiliated markets).
• Independent Sellers: Individual shopkeepers and vendors operate as independent business entities. Mobile Plaza is not the owner, manufacturer, or direct seller of the used or new mobile phones advertised, nor does Mobile Plaza act as an escrow agent for physical exchange of cash or merchandise.
• Inspection Obligation: Buyers are strongly advised to physically verify the device, check the IMEI number with PTA/CPLC databases, inspect battery health, and test display condition at the shop counter prior to final cash settlement.
3 Shopkeeper Eligibility, Verification & Accounts
To register a verified shop profile and post mobile inventory:
- You must be at least 18 years of age and legally authorized to conduct commercial retail business in Pakistan.
- You must provide accurate, verifiable details including your shop name, physical shop number, plaza name, and active Pakistani WhatsApp contact number.
- You are strictly responsible for maintaining the confidentiality of your account password and API sync tokens. All actions performed under your credentials are your legal responsibility.
4 Listing Rules & Prohibited Items
To maintain a clean, trustworthy marketplace compliant with Google Publisher Policies and Pakistani law, all users agree to adhere to the following listing regulations:
- Stolen or Snatched Mobile Phones: Any handset reported to CPLC, Police 15, or FIA.
- Tampered or Duplicated IMEI Numbers: Modifying or flashing illegal IMEI codes is a federal offense under the Prevention of Electronic Crimes Act (PECA).
- Counterfeit / First Copy / Replica Handsets: Selling fake clones labeled as original Apple, Samsung, or Google phones.
- Fraudulent / Bait Pricing: Posting unrealistically low demand rates to deceive buyers or manipulate search results.
5 PTA Approval Status & Accurate Specifications
Under Pakistan Telecommunication Authority (PTA) regulations, every cellular device operates under specific regulatory status. Shopkeepers must honestly declare:
- Official PTA Approved: Valid custom duties paid and approved on official DIRBS.
- CPID Approved: Server registered device.
- Non-PTA / Sim Lock: Unapproved device requiring PTA tax payment by the purchaser.
- Patch / Soft Approved: Software bypass (must be disclosed explicitly).
Misrepresenting PTA approval status or claiming a Non-PTA unit as Official PTA Approved is grounds for immediate listing removal and account ban.
6 WhatsApp Channel Auto-Posting Authorization
When you activate the WhatsApp Channel & Auto-Posting Sync feature in your shop dashboard:
- You authorize Mobile Plaza to ingest, parse, and publish broadcast messages and media posted to your registered WhatsApp Channel onto your public shop profile.
- You confirm that you hold all intellectual property rights or ownership of photographs posted to your channel.
- You agree that automatically parsed specifications (model, memory, rate) represent an advertisement offer under your shop's responsibility.
7 Subscription Fees, Billing & Grace Period
Mobile Plaza provides verified shopkeepers with inventory hosting, search indexing, and POS management:
- Monthly Platform Fee: Standard monthly subscription dues are payable in advance via designated JazzCash, EasyPaisa, or direct bank transfer accounts.
- Grace Period: Accounts receive an automated 5-day grace period upon subscription expiry. If renewal is not completed, active listings may be temporarily unlisted until payment verification.
- Refund Policy: Platform subscription fees cover digital server hosting and are non-refundable once an active billing cycle has commenced.
8 Intellectual Property & Third-Party Trademarks
The Mobile Plaza website, source code, logo, brand assets, and proprietary NLP parser engines are the intellectual property of Mobile Plaza.
Third-Party Trademarks: Brand names, model designations, and logos such as Apple, iPhone, iPad, Samsung, Galaxy, Xiaomi, Redmi, Google, Pixel, Oppo, Vivo, Infinix, Tecno and others are trademarks of their respective copyright holders. Their reference on our marketplace is strictly descriptive to accurately identify devices being traded by independent shops.
9 Disclaimer of Warranties & Limitation of Liability
• "AS IS" Basis: To the maximum extent permitted by applicable law, Mobile Plaza is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
• Limitation: In no event shall Mobile Plaza, its directors, or developers be liable for any indirect, incidental, punitive, or consequential damages resulting from transactions conducted between buyers and sellers, device defect claims, or temporary server downtime.
10 Account Suspension, Termination & Ad Removal
Plaza administration reserves the absolute right to modify, deactivate, or permanently delete any listing or shop account without prior notice if:
- The account engages in fraudulent customer dealings or counterfeit stock sales.
- A mobile phone is identified on stolen device registries (CPLC/PTA).
- The user breaches any provision of these Terms & Conditions.
11 Governing Law & Dispute Resolution
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising out of or in connection with the platform shall be subject to the exclusive jurisdiction of the competent civil and commercial courts of Abbottabad, Khyber Pakhtunkhwa (KPK), Pakistan.
